Welcome to Love Pets and Memories ("we," "us," "our"). By accessing or using our website and services at lovepetsandmemories.com, you agree to these Terms of Service ("Terms"). If you do not agree, please discontinue use.
Love Pets and Memories provides tools for creating personalized trading cards and related made-to-order keepsakes. Products are prepared through our in-house fulfillment workflow. Payments are processed exclusively through Stripe.
You must be at least 18 years old or have consent of a parent/guardian. An account is required to upload content, create products, and place orders. You are responsible for safeguarding your credentials and for all activity under your account.
On-site pricing may be displayed in USD or CAD depending on the browsing context. Final checkout is processed in CAD unless stated otherwise. Prices may change without notice.
Payments are processed by Stripe. We do not store full card data on our servers. Charges are per order - no subscriptions or recurring fees.
An order is confirmed after successful payment. Once an order enters production, it cannot be changed or canceled.
You are responsible for any applicable sales taxes, VAT/GST/HST, customs duties, and import fees assessed by your jurisdiction or carrier.
You must provide a complete and accurate shipping address. We are not responsible for non-delivery due to incorrect addresses. Unauthorized or reversed payments (chargebacks) may result in suspension and a processing fee.
Products are made to order through our in-house production workflow and shipped through third-party carriers. Timelines are estimates and may vary due to production capacity, destination, carrier performance, or customs.
If a product arrives defective or materially different from your approved design, contact us within 7 days of delivery with your order number and clear photos. If approved, we will replace, reprint, or otherwise remediate the order at our discretion.
No refunds for: (a) customer errors (typos, wrong file), (b) change of mind, (c) minor variations in color/brightness/trim, (d) shipping delays, or (e) dissatisfaction with AI output.
You are solely responsible for content you upload or generate. You represent and warrant that you own the rights to it, or have all permissions needed, and that it does not infringe any third-party rights or applicable law.
You grant Love Pets and Memories a limited, non-exclusive, worldwide, royalty-free license to host, reproduce, adapt (e.g., resize, crop), and transmit your content solely to: (i) provide the services; (ii) produce and deliver your order via our internal workflows or fulfillment partners where applicable; and (iii) comply with legal/accounting obligations. This license terminates when we delete your content from our systems.
With your explicit opt-in, you grant us a limited license to display your finalized product images in our marketing (e.g., site gallery). You can withdraw consent at any time in your account settings; withdrawal does not affect prior lawful use.
We may refuse, remove, or cancel any order/content that we believe violates rights or policies. We may suspend or terminate accounts engaging in abuse or infringement.
Our AI tools (powered by third-party providers such as OpenAI) generate content based on your prompts. We do not guarantee accuracy, originality, or suitability. You assume all risk for use of AI-generated content.
Love Pets and Memories is not affiliated with or endorsed by any brand, franchise, or intellectual property owner. The Love Pets and Memories platform, website, and branding are our property. User-generated designs remain the property of their respective owners.
We may modify, suspend, or discontinue any part of the service. We may update these Terms with notice where required. Continued use after changes constitutes acceptance.
To the fullest extent permitted by law, Love Pets and Memories and its affiliates are not liable for indirect, incidental, special, or consequential damages, or for delays, carrier issues, minor production variances, or losses arising from user/AI content. Our aggregate liability is limited to the amount you paid for the affected product.
You agree to indemnify and hold Love Pets and Memories harmless from claims arising out of your content, your use of the services, or your breach of these Terms.
These Terms are governed by the laws of Ontario, Canada. The courts of Ontario have exclusive jurisdiction, unless applicable consumer law provides otherwise.
We are not liable for failure or delay due to events beyond our reasonable control, including natural disasters, strikes, outages, or third-party failures.
If any provision is unenforceable, the remainder remains in effect. These Terms and the Privacy Policy are the entire agreement between you and Love Pets and Memories.
